Why is this a Special Election?

Typically, the Governor of Ohio replaces judges that resign before the end of their term pursuant to Article IV, Section 13 of the Ohio Constitution.  However, that article goes on to say, that the appointment is only "until a successor is elected and has qualified; and such successor shall be elected for the unexpired term, at the first general election for the office which is vacant that occurs more than forty days after the vacancy shall have occurred...." 

The sitting judge, James Schuck resigned and left his seat vacant with over 3 years left in his term.  Thus, a replacement judge is needed to complete his term.

In this instance, each major political party nominated a candidate, and both nominees were verified and approved for the November Ballot as candidates by the Delaware County Board of Elections.  This allows the residents of Delaware County to ELECT the next judge from among their neighbors, rather than to have the Governor appoint a political crony.
